Audits in accordance with the Regulation on Real Estate Agents and Property Developers (MaBV)

Pursuant to § 34c of the German Industrial Code (GewO), separate permits are required to offer certain products and services on a commercial basis. This is to prevent unsuitable persons from working as credit agents or brokers, property developers or construction project managers, or as residential property managers.

Pursuant to § 16 Par. 1 MaBV, traders meeting the criteria of § 34c Par. 1 sentence 1 no. 2 and no. 4 GewO are required to commission an audit once per calendar year to assess their compliance with the obligations under §§ 2 – 14 MaBV and submit the report to the competent authority by 31 December of the following year.
